In a judgment released on September 14, 2023, the Court of Appeal in Abuja reversed the decision of the National and State House of Assembly Election Tribunal in Asaba, Delta State, which had declared PDP's Ndudi Elumelu as the winner of the House of Representatives election in the Aniocha/Oshimili Federal Constituency.

The appellate court affirmed Labour Party's Ngozi Okolie as the rightful winner, having pulled in a total of 53,879 votes compared to Elumelu's 33,456 votes and Tony Nwaake's 11,712 votes.
