The state prosecution agency and the victim in Dani Alves’ rape case are both appealing to increase the player’s sentence, which is currently four-and-a-half years.
Despite Alves providing €150k in damages to the victim, both parties argue that this amount should not have been considered as a mitigating circumstance due to Alves’ means. The minimum sentence for Alves’ crime is four years, with the possibility of a twelve-year maximum sentence.
The state prosecution will argue against the mitigating circumstance, as Alves has not shown regret or accepted his sentence. Alves’ defense is seeking bail and appealing to further reduce the sentence. If the court deems the victim adequately compensated, Alves’ sentence could be reduced to two years, with over a year already served.
There is also a possibility of Alves being eligible for day release in July and potentially early release for good behavior after serving three-quarters of his sentence.
