Despite a Supreme Court order for him to withdraw his appeal against the Kogi West senatorial primary election, Senator Smart Adeyemi has refused to do so.

In July, the Kogi State High Court had declared that Mr Adeyemi was not a lawful candidate of the ruling All Progressives Congress (APC) in the primary election held on May 28.

However, the senator appealed the judgment and the Supreme Court issued an order for him to withdraw the appeal.Yet, despite the order, Mr Adeyemi's lawyer, Rickey Tarfa, SAN, refused to withdraw the appeal.

According to Mr Tarfa, the Supreme Court lacks the jurisdiction to order the withdrawal of the appeal. He also argued that the Kogi State High Court judgment was "a nullity".

The case is now before the Court of Appeal in Abuja and is scheduled for hearing on October 24. Mr Adeyemi, a member of the APC, is seeking to be re-elected to the Senate in 2023.
