In the motion filed through his legal representative, Marvin Omorogbe, Ofoegbu requested the court to either release him from prison or grant him bail while the investigation by the Inspector General of Police is ongoing.

Ofoegbu's detention by the Nigeria Police Force is reportedly linked to his public statements against Evangelist Ebuka Obi, whom he accused of dishonesty and labeled his miracles as deceitful, urging law enforcement to intervene.

Following his invitation to the police station in Abuja for alleged criminal offenses such as intimidation, threats, cyberstalking, and cyberbullying against the pastor, Ofoegbu was not released and was instead transferred to Keffi Correctional Centre in Nasarawa State.

In the court document, Ofoegbu requested the court to revoke the remand order issued on March 21, 2024, and secure his release, or alternatively, grant him bail until the police investigation is concluded. He argued that the police misled the court by concealing crucial facts, including his voluntary compliance with their invitation and lack of prior arrest.

Ofoegbu emphasized his presumption of innocence until proven guilty, his right to liberty, and his willingness to cooperate with the investigation, highlighting that the alleged offense is bailable and that he has no criminal record.
